Terms of Use

Section 1

Overview

These Terms of Use ("Terms") constitute a legally binding agreement between you and BMOZI LLC ("BMOZI," "Company," "we," "us," or "our"), governing your access to and use of the Covenant Path mobile application and any related services, websites, and content (collectively, the "Service"). By downloading, installing, or using the Covenant Path app, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.

Section 2

Eligibility

• Age Requirement: You must be at least 13 years old to use the Covenant Path app. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Account Accuracy: You agree to provide accurate, current, and complete information when creating an account, and to update that information as needed. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.

Mission and Inclusivity

BMOZI is committed to fostering spiritual growth through the Covenant Path app. We welcome people from all faiths, beliefs, and walks of life. Our platform emphasizes daily steps toward living a meaningful and faith-driven life, whether or not one identifies with a particular religion.

Section 4

Data Collection and Analytics

• Analytics: We use analytics services (including Firebase Analytics and Crashlytics) to collect anonymized usage data such as feature engagement, session duration, and crash reports. This data helps us improve app stability and user experience.
• Personal Data: We collect information you provide directly, including your display name, email address, journal entries, and reading progress. Your journal entries are stored in encrypted form and are never shared with third parties.
• No Sale of Data: We will never sell, rent, or trade your personal data to third parties. Data is shared only with service providers necessary to operate the app (e.g., Firebase, RevenueCat, AI providers) as described in our Privacy Policy.

Section 5

User Responsibilities

• Ensure any content you submit aligns with our mission of inclusivity and respect.
• Do not misuse the application for unlawful or harmful activities.
• Do not attempt to reverse-engineer, decompile, or extract source code from the Covenant Path app.
• Do not use automated scripts, bots, or scrapers to access the Service or artificially inflate XP, Covenant Gems, or leaderboard rankings.
• Do not impersonate another person, misrepresent your affiliation, or create multiple accounts to circumvent restrictions.
• You are solely responsible for all activity that occurs under your account.

Section 6

AI-Generated Content Disclaimer

• Artificial Intelligence Features: Our application uses third-party artificial intelligence services (including Anthropic Claude, OpenAI, and ElevenLabs) to provide features such as scripture recommendations, study companion responses, journal prompts, and voice synthesis.
• No Guarantee of Accuracy: AI-generated content is provided "as is" without warranties of any kind. While we strive to ensure AI responses align with our faith-based mission, AI systems may occasionally produce inaccurate, incomplete, or unexpected outputs.
• Not a Substitute for Scripture Study: AI-generated scripture recommendations and study assistance are intended to supplement, not replace, personal scripture study, prayer, and guidance from ecclesiastical leaders.
• Third-Party Processing: Your inputs to AI features are processed by third-party AI providers according to their respective terms of service and privacy policies. By using AI features, you acknowledge and consent to this processing.
• Content Filtering: We employ content filtering to align AI responses with our mission, but we cannot guarantee that all AI-generated content will meet your expectations or requirements.

Section 7

Subscriptions and In-App Purchases

• Subscription Tiers: Our application offers optional subscription tiers (Disciple, Covenant Keeper, and Lifetime) that provide access to premium features including exclusive themes, enhanced AI capabilities, and additional content.
• Payment Processing: All payments are processed through Apple App Store or Google Play Store. We do not directly collect, store, or process your payment information (credit card numbers, billing addresses, etc.). Payment transactions are subject to the terms and privacy policies of Apple or Google.
• Subscription Management: Subscription status and entitlements are managed through RevenueCat, a third-party subscription management platform. RevenueCat receives anonymized transaction data to verify your subscription status. See RevenueCat's privacy policy at revenuecat.com/privacy for details.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple App Store or Google Play Store account settings.
• Refunds: Refund requests must be submitted directly to Apple or Google through their respective app stores. We cannot process refunds directly.
• Price Changes: We reserve the right to change subscription prices. You will be notified of any price changes before they take effect, and changes will not affect your current billing period.

Section 8

Image Content

• User-Uploaded Images: You may attach images to your journal entries. By uploading images, you represent that you own the rights to the images or have permission to use them.
• Image Storage: Images are stored securely in our cloud storage (Firebase Storage) and are associated with your account. Images are not shared with third parties except as necessary to provide the service.
• Prohibited Content: You agree not to upload images that are illegal, offensive, infringe on others' rights, or violate our community standards. We reserve the right to remove any images that violate these terms.
• Image Deletion: When you delete a journal entry or your account, associated images are permanently deleted from our servers.

Section 9

Community Features

• Inner Circle: Our app includes community features that allow you to connect with other users in your "Inner Circle." By using these features, you consent to your display name and progress information being visible to your Inner Circle members.
• Leaderboards: If you participate in leaderboards, your display name, level, and XP may be visible to other users.
• User Conduct: You agree to interact respectfully with other community members. Harassment, spam, or inappropriate behavior may result in account suspension or termination.
• Privacy of Others: Respect the privacy of other users. Do not share personal information about other users outside the app.

Section 10

Covenant Gems Virtual Currency

• Virtual Currency: Covenant Gems are a virtual currency used exclusively within our application to access premium AI-powered features. Covenant Gems have no monetary value outside the application.
• No Real-World Value: Covenant Gems cannot be exchanged, transferred, sold, or redeemed for cash, credit, or any other form of currency or consideration. They are not property and have no value outside the application.
• XP Redemption: Covenant Gems can be obtained by redeeming XP earned through app activities. XP redemptions are final.
• Balance Modifications: We reserve the right to modify, adjust, or reset Covenant Gem balances in cases of fraud, abuse, technical errors, or violations of these terms.
• Service Termination: Upon termination of your account or discontinuation of the service, all Covenant Gems will be forfeited without compensation.
• Earning Limits: We may impose daily, weekly, or monthly limits on earned Covenant Gems. These limits may change at our discretion.

Section 11

Limitation of Liability

• To the maximum extent permitted by applicable law, the Company, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application or AI features.
• AI Feature Liability: We are not liable for any decisions, actions, or outcomes based on AI-generated content. This includes, but is not limited to, scripture interpretations, spiritual guidance, or personal reflections.
• Third-Party Services: We are not responsible for the actions, content, or data processing practices of third-party AI providers (Anthropic, OpenAI, ElevenLabs) or payment processors (Apple, Google).
• Maximum Liability: Our total liability to you for any claims arising from your use of the application shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
• Essential Purpose: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Section 12

Indemnification

• Agreement to Indemnify: You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the application.
• Scope of Indemnification: This indemnification includes, but is not limited to, claims arising from: (a) your content submissions; (b) your use of AI features; (c) your violation of any third-party rights; (d) your violation of applicable laws; and (e) any unauthorized use of your account.
• Cooperation: We reserve the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.

Section 13

General Disclaimers

• Content provided on the application is for informational and inspirational purposes only.
• We are not responsible for outcomes based on application interactions or recommendations.
• The application is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not warrant that the application will be uninterrupted, error-free, or free of viruses or other harmful components.
• AI Limitations: AI-powered features may produce inaccurate, incomplete, or inappropriate responses. AI suggestions should not be considered authoritative scripture interpretation or spiritual counsel. Always verify AI-generated content against official scripture sources and consult with qualified spiritual leaders for personal guidance.
• No Guarantee of Future Features: We do not guarantee the availability of any specific features, updates, or future releases. Features may be added, modified, or removed at our sole discretion. Subscription benefits are based on features available at the time of use.
• Service Continuity: We do not guarantee that the application or any of its features will be available indefinitely. We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

Section 14

Intellectual Property

• Our Content: The Covenant Path app, including its design, code, graphics, logos, icons, audio, and written content, is the property of BMOZI LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
• Your Content: You retain ownership of content you create within the app (such as journal entries and notes). By submitting content, you grant BMOZI a limited, non-exclusive license to store, process, and display that content solely to provide the Service to you.
• Feedback: If you provide suggestions, ideas, or feedback about the Service, you grant BMOZI the right to use that feedback without restriction or compensation.

Section 15

Account Termination

• Termination by You: You may delete your account at any time through the app settings. Upon deletion, your personal data and journal entries will be permanently removed from our servers in accordance with our Privacy Policy.
• Termination by Us: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. We will make reasonable efforts to notify you before termination, except where immediate action is necessary to protect the Service or other users.
• Effect of Termination: Upon termination, your right to access the Service ceases immediately. Any unused Covenant Gems, subscription time, or other virtual items are forfeited. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

Section 16

Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, notify you through the app or via email. Your continued use of the Covenant Path app after revised Terms take effect constitutes your acceptance of those changes. If you do not agree to the revised Terms, you should stop using the Service.

Section 17

Governing Law and Disputes

• Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict-of-law principles.
• Dispute Resolution: Any dispute arising from these Terms or your use of the Service will first be addressed through good-faith negotiation. If unresolved within 30 days, either party may pursue binding arbitration administered under the rules of the American Arbitration Association in Utah County, Utah.
• Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
